This was my original point, so long as using a VPN isn't banned in the terms of usage that you signed, you aren't violating any terms of the contract.

But using file-sharing and playing games etc. probably is - which is what he is using the vpn for - and therefore breaking the contract. The VPN itself might not be against the contract - but he is still using it to engage in activity that is (ignoring the fact that they might not ever find out what he was using it for)

Since they have no idea what the traffic over the VPN is, they can't ban on the grounds that it's definitely being used to subvert the contract.

Anyway, like I said ages ago, It's not worth worrying about. Games traffic isn't going to draw any attention at all. Network Techs only care if you're having a disproportionate effect on the network performance or if you're doing something illegal that will be traced back to the Uni's IP block. We'd rather spend our time between projects and crises drinking coffee and browsing the net, not going on a witchhunt for ToS violations.

Certainly at my uni they don't bother policing downloading until they get an email complaint from a copyright holder

You're missing another point Zarf. You're using a Uni network to gain access to the external internet. The uni has a right to say what traffic they allow and sadly, this means that if they don't understand the traffic, or can't identify it then they're likely to just take the easy option and shut it off. They'll just amend the TOS.

You're right in that you have a right to encrypt your data, this doesn't mean that everyone is obliged to carry it. Whilst I don't agree that this is right, I can at least understand it from the University's point of view.

still complain to your reps hawt, do it. I understand if the uni wishes to restrict, library, teching centre, office computers etc to pure academic use. But residential internet restrictions are unacceptable and out of touch. You are paying fees for your residence and you have a right to expect a certain standard including relatively free access to the internet. Liverpool have had to introduce a download limit... of 30gb a week! Which is better than most isps..., this is the only restriction applied despite having to log on and install some awful stuff that checks you have adequate AV protection etc (must find that and remove it). The only other thing they do is take action when they receive email complaints about copyright but thats rare unless you are some kindof massive pirate who is also stupid.
