You report your car stolen. A little later that car is found abandoned, having caused some damage (let's say it hit another car). Police can't determine who was driving the car.
Who's paying for the damage on the other car? Insurance? What if no insurance exists (and, for the sake of argument, it wasn't mandatory)?

(I'll tell you later what this has to do with TF2 if you haven't already figured it out)

If this is the angle you are going for Tea, then I think a better question to ask would be 'would the owner of the car would be sent to prison for reckless driving', rather than the insurance analogy.

Ok - the type of insurance claim would in theory be 3rd party (you/your car caused damage to another car - even though you weren't driving it.)

If it was me in that situation I would point out to them that you had reported the car as stolen - and that was *before* the damage to the other car and since they can't prove it was you that was driving it shouldn't be a claim on your insurance.

I highly doubt your insurance company would pay out - they would find out/you would tell them that the car was stolen.

In any case - if you didn't have insurance it wouldn't be that you would have to pay. I believe in the UK (and this is what happened to me) the damages would be paid by the motor insurance bureau.

MIB was established in 1946 to compensate the victims of negligent uninsured and untraced motorists

I guess if the MIB didn't exist then I suppose they driver of damaged car might take you to court and you would have to prove that you weren't driving? Or the police would catch the person that stole the car (HAHAHAHAHAHAHAAAAHAHAHAAAAAAAaaaaa FAT CHANCE) and then it would be their responsibility to pay.

DodgyEmu: it would probably go to court - and again they would have to prove it was you driving the car...innocent until proven guilty etc. etc. so probably no prison if you a) reported the car as stolen, b) have an alibi (i.e. were at work) etc. etc.

TLDR: neither you or your insurance company would pay out if they couldn't prove you were driving the car (because you had reported it as stolen)

I guess a lawyer is needed on this one

The MIB will only pay out if it can be conclusively proven that the perpetrator of the crime was an alien lifeform   However, since they are obliged to erase your memory in such cases, you won't be able to explain where the money came from and will subsequently end up in prison for money laundering/fraud. Either way you get bummed

If the person being hit by the car only has 3rd party insurance then their insurance won't pay for the damage to their car.

e.g. Person A crashes into Person B (and it is Person A's fault) then Person A's insurance pays out for the damage on Person B's car - the damage to their own car is not covered with 3rd party insurance. Which is where the MIB fits in (and no nineblade - not the ben in mlack).

if we are talking VAC analogies though its more like the locking mechanism was designed badly and you could easily get an impression of the keys, like fitting a car door with a tumbler lock, instead of electronic locking.

But person A isn't insured, because they stole the car, so person B has to claim on their own insurance because person A doesn't have insurance. Person A however, if caught and convicted, would be liable to paying costs.
