Well, there are several techniques an ISP can deploy to detect filesharing, with varying degrees of success, depending on how well the client/network (try to) hide it's activity.
The fun part part is detecting whether or not that file is illegal, there are very legal filesharing uses out there, as far as I know, the WOW updater secretly uses it.

(Edit: Secretly might not be the right word here, it does tell you, it just is a zero-config client that requires the user to do nothing.)

Well, theoretically they could search the internet for the illegal links (the users need to find the files SOMEHOW) and compare those, but yeah, that'd make it kinda hard.
Even with "normal" names it's hard to tell. And keep in mind, a machine should filter it, because once you employ humans, stuff like that get expensive. Do you filter anything containing "iron man"? Then you'll also filter everything that contains man and ironically.
That's kinda the problem: You can't really detect if a file is legal. So do you force distributers (search engines, rapidshare, p2p client developers, etc.) to filter those words, to employ hundreds of employees (which are far from failsafe) or do you give them a free pass?

Sure, once a file is identified, you can use the hash (like a fingerprint of a file, in theory unique) to filter, but to escape that you can change a single bit in the file and keep on going.

About the word filtering: Look at isoHunts case. There was a film named Firefox in 1982, so they are now forced to prevent files containing the word Firefox to be found via their site.

Tunnelling should make it impossible for them to identify what you are doing and even if they flag you for it you should be able to squash that on appeal. Only problem is they are talking about making people pay for their appeals...

Also skyanytime and 4od torrent stuff, iplayer used to. relic and blizzard yup. and so does spotify, they can't rely on traffic types or they'll end up in a massive mess and get counter-sued to shit for harassing people.
